I.C.E. Is way out of line.

This is what happens when top leadership is incompetent. All this does is to act as a “terrorist act” against innocent people. 

This is malicious prosecution of which Homeland Security and the AG offices are now liable. 

Mr. Espinal is racially profiled. There is no arrest by federal officials within immigration law of people who overstay a Visa. When a person over stays a USA Visa they have already been through whatever background check was necessary at the time the Visa was issued. They have been granted lawful entry into the USA with the issuance of the Visa. It is a very different issue than illegal entry.

Any overstay of Visas is an administrative issue and not a criminal issue. People are not arrested for this. They are notified they will not be allowed reentry to USA because they overstayed their Visa. People often return home, especially vitally needed Philippine nurses, only to return with the issuance of a new Visa. It is this process people often overlook and in doing so put their return to the USA in jeopardy. It is sort of the same as driving with an expired driver’s license. 

So, Mr. Espinal and his loved ones have been wrongfully traumatized and should seek recourse against the USA for all their troubles and fear.
