The US Senate is playing with the Executive Order regarding Indian Tribes. The federal government is ONLY required under this amendment to CONSULT with the Indian Tribes in regard to the Keystone XL Pipeline, not have permission to provide a right of way to the pipeline.

The amendment is unnecessary and is covered in treaties with the USA. 

Senator Cardin states the Barrasso amendment will provide compromise that is much needed in a well researched approach to the KXL. Evidently, Carden had an amendment and he with it since Barrasso's amendment was carried into the bill.

I repeat this is a function of the US State Department and Executive Branch. Any and all modifications with Indian Tribes belongs with the US State Department. Indian Tribes are independent nations of people with treaties and cannot be altered without the express permission of the tribes themselves. 

It looks like the next vote is for the bill itself; so they slid this one in right before they closed amendments and passed it merely with a voice vote.

It appears as though not all the amendments were voted on, this one is submitted by Senator Markey which is to wait until the Executive Branch finishes it's work on the border issue. Why is it that when it comes to blaming the President for southern border problems he gets all the credit, but, when it comes to managing the northern border he gets none? Interesting. An invasion by the foreign petroleum industry is a good idea, but, the undocumented are criminals.

No surprise here the amendment wasn't passed. 

The next Markey Amendment is to require the Canadians have to pay into the Oil Spill Liability Fund. Of course, Murkowski stated there is no need for this amendment because there is a 'sense of the Senate' already passed. Sorry, folks, but a 'sense of the Senate' holds no enforcement brevity. 

This is typical Republican nonsense. They always try to pass words through on bills that are meaningless and carry no enforcement brevity. Typical. 

Think about the bizarre attitude Republicans have when they LEAVE loopholes in country's laws. Republicans in the House are scouring the food stamp program and any other program that doesn't result in profits for someone, but, when in the Senate the foreign oil concerns were going to open the door just a crack to remove any obligation for the Oil Spill Liability Fund. So, if this 'sense of the Senate' were to become the overriding law of the land, that means BP could come back in and ask for a refund from the liability fund. Now, granted it would require a court fight, but, every company that ever paid into the Oil Spill Liability Fund would be looking to get out of their obligation and quite possibly asking for a refund for years past.

Americans have to be careful with a majority legislature of Republicans. They rob American blind and look to be re-elected. Just think about the potential for them to do harm for two years. 

They have already hacked away at bank regulations and are expecting to do more.

There ya go. The Markey Amendment was defeated. Sorry Americans, you lose.

The Senate Keystone XL Bill failed to pass. There were 57 and then a few stragglers came along and passed it. It is going to the President for signature.
