Bush/Cheney nearly scammed the public of their 401Ks before they left in January 2009.

The Obama/Biden Administration stopped this in the nick of time. The American Electorate simply can't return this kind of power back to Republicans. Would not be a good idea.

The Executive Branch of the USA is very powerful. They 'administer' the laws of the country. Responsible and Learned people need to be in those offices. This is a 'big one.'

Don't be fooled by rhetoric.



There was a press release on February 26, 2010 about clarifying the kind of advice citizens receive regarding their 401K. There is a Task Force to allow public commentary on changes to the regulations governing how people receive advice.

What the public announcement doesn't say is that the Bush/Cheney administration was on the verge of scamming the public, while putting their investments at risk. The Bush/Cheney administration was allowing provisions that advisers could direct their advice to serve their own best interests, regardless, of the risk to the public.

U.S. Labor Department rules to improve retirement security announced as part of White House Middle Class Task Force's year-end report
Rules enhance retirement advice and transparency for workers

Washington – Today, at a White House forum hosted by Vice President Joe Biden, the U.S. Department of Labor announced two new rules designed to enhance retirement security and transparency for the millions of workers covered by 401(k), pension and other retirement arrangements. The announcement was part of the White House Middle Class Task Force's year-end report, which the vice president released at this morning's event.

During the past year, the Middle Class Task Force has focused on solutions to the challenges facing America's middle class - including retirement security and the need for high-quality jobs for middle class workers. The report details the year's work of the task force, and it includes a proposed rule on investment advice. The department also is announcing the publication of a final rule on multiemployer plan transparency....

Below is part of the analysis that lead up to the Task Force. I don't want to hear how the Obama/Biden Administration is doing anything except the people's work. They are shifting through a mess created over eight years of 'advantageous Republican' planning in order to better safeguard the American people from losing everything.

  • EBSA is responsible for administering and enforcing the fiduciary, reporting, and disclosure provisions of Title I of the ERISA. The agency oversees approximately 708,000 private pension plans, including 483,000 participant-directed individual account plans such as 401(k)-type plans, and millions of private health and welfare plans that are subject to ERISA.

  • As of 2007, more than one-half of private-sector employees participated in defined contribution plans that allow for participant direction, with these plans covering 60 million active participants and holding about $3 trillion in assets.

  • In general, investment advice given by an investment adviser to plan participants on investments that pay additional fees to the adviser or its affiliates can violate the prohibited transaction rules of ERISA and the Internal Revenue Code. This has limited the types of investment advice arrangements available to participants in 401(k) plans and IRAs.

  • Given the rise in participation in 401(k) type plans and IRAs, the retirement security of millions of America’s workers increasingly depends on their investment decisions. Thus, there is increased recognition of the importance of investment advice in helping participants avoid costly investment errors.

  • The Department published a Request for Information in December 2006, published a proposed regulation in August 2008, and held a public hearing on October 21, 2008. A final rule and related class exemption published in January 2009 were withdrawn in November 2010 in response to concerns raised in public comment letters questioning the adequacy of the final class exemption's conditions to mitigate the potential for investment adviser self-dealing.

Basically what that says, above, is that the Administration of Obama/Biden discovered public comment that was IGNORED by the Bush/Cheney Administration when they published the proposed change in rules governing all those monies. The American People were about to be fleeced AGAIN.

I imagine Halliburton would love to get their hands on that volume of funds in order to facilitate their further extortion of the American people.

A devastating earthquake in Chile has triggered a tsunami which is radiating across the Pacific and has already caused serious damage on the islands said to have inspired Robinson Crusoe.

The quake, registered at magnitude 8.8 on the Richter scale, caused buildings and bridges to collapse and led to power-black outs in parts of the Chilean capital, Santiago, 200 miles from the epicentre.

One has to keep in mind 'the mass' of any plate to move. The Pacific Plate and North American Plates have significantly larger mass and effect global movement more than any other plates.



The Pacific Plate and the Nazca Plate are related at a boundary. So is the Pacific Plate and the North American Plate. When the Pacific Plate moves the others do as well. There have been small earth quakes along the North American Plate in California and Alaska. The Nazca Plate is usually more stable than the North American Plate, but, it is my 'suggestion' that the Climate Crisis has spawned instability in the Polar Regions of these plates and are allowing for significant movement. If one notes the Nazca Plate is neighbor to the Antactic Plate as well.

MANILA, Philippines (Xinhua) - A magnitude-5.5 offshore earthquake struck the southern Philippines Friday afternoon, the country's quake monitoring network reported. But there was no immediate report of casualties.

The epicenter of the quake was located at a depth of 121 km in the Philippine sea, about 92 km southeast of the city of Mati, Davao Oriental province, the Philippine Institute of Volcanology and Seismology said in a bulletin.

The institute said the quake struck 4:37 p.m. local time (0837 GMT) but it did not issue tsunami alert.

The tremor was felt in major coastal cities in the southeast Mindanao region.

The Philippines sits on the Pacific "Ring of Fire" where continental plates collide causing frequent seismic and volcanic activities.

February 27, a powerful 7 magnitude earthquake struck Japan. According to U.S. Geological Survey, the epicenter focus was at the depth of 22 kilometers.

A tsunami warning was initially issued, but later lifted. The quake epicenter was 81km off the southern Japanese island of Okinawa, BBC reports.

No information on victims and casualties is available.

Another 5.1 magnitude earthquake hit Philippines. The epicenter was 140 km south of Davao city, Mindanao Island. There are no reports of injured and damages.

CANBERRA, Feb. 27 (Xinhua) -- The Joint Australian Tsunami Warning Center (JATWC) on Saturday night issued tsunami warnings for the marine environment to New South Wales state, Queensland state, Lord Howe Island and Norfolk Island.

It says there is "potential tsunami threat" to the above states and possibility of dangerous waves, strong ocean currents and foreshore flooding for several hours from Sunday morning.

Sea level observations have confirmed a tsunami has been generated, according to the center.

The warning says "Tsunami waves are more powerful than the same size beach waves, with the first wave not always the largest. Do not go to the coast to watch the tsunami. Check that your neighbors have received this advice. Boats in close should return quickly if possible. Boats in deep water should stay offshore until further advised."

Tsunami source comes from an undersea earthquake of magnitude 8. 8 occurred at 3:34 p.m. local time on Saturday near the coast of central chile (latitude 35.320S longitude 72.930W), it says.

Let me enter this as a point of bigotry. The Religious Right takes scripture out of context. Romans 1:27. The Anti-Gay Stand.

Below is a picture of a Roman Legion or some darn thing. It was taken from this site (click title to entry - thank you). The site argues that one of the reasons the Roman Empire fell was due to a Eunuch Uprising. The timing is right. The Roman Empire is considered to have ended about 475 AD.

The passage above is from the Bible. Like I said before it is a very old book. The passage is taken out of context. The passage is considered a Pauline Epistle. No, Pauline is not a woman. The Pauline Epistles are the writing of Paul the Apostle.

And of course everyone knows whom Paul is, right? No? Hm.

Paul changed his name when he became an Apostle. His name was Saul. Saul is a Roman name. Paul was a Roman. He gave up that venue of 'status' to preach the word of Jesus Christ. So, in writing the book of Romans, Paul had an intimate knowledge of Roman society and its underpinnings.

I had no idea up to last week that the Religious Right was using this passage to facilitate hate toward gays. I heard it on a Conservative Christian radio. They are not correct. But, they don't care. They see words on a page and preach hate in order to create the most powerful Christian nation on Earth. I mean every word of it.

But, to get back to Paul and the passage.

Basically, Prop 8 is based ONLY in bigotry. There is no religious basis and certainly no constitutional basis for it.

But, back to Paul.

Roman society was run based on power structures and the ability of 'families' to control outcomes to 'friends' to insure elections went there way. Romans were bigots themselves. They were also polytheistic. The Italian Rome was not a good fortress either. The Italian Rome was 'the power seat' to the Ceasars. I could get into the other Emperor families like the Antonians and all those folks, but, for the most part when people think of the Roman Empire they think of Ceasar.

The Ceasars held power over the military of Rome, including the calvary and navy. Their power was 'godlike' and undiluted. It was nearly impossible for anyone outside that 'family structure' to rise to power in Rome. But, IF, a 'smart' Roman were able to overthrow the empire from within by 'let's say, a theology shift' it might actually work and someone like Paul could take over control of the empire.

In actuality, that is exactly what occurred. The power in the Italian Rome diminished in time and shifted to The Byzantine Rome. The Byzantine Rome was the Eastern Empire (click here) with its capital in Turkey.

The point is that the writings that 'became' the Bible were written in a very different time and under very different circumstances. In the case of Paul, his writings had a 'Anti-Rome' political theme. That 'theme' was picked up on and there was a huge theology shift from polytheism to monotheism.

Yes that monotheism was facilitated by the Hebrew beliefs, but, Jesus Christ was a Rabbi and a teacher. Okay?

The passages by Paul (The Pauline Epistles) are somewhat a political writing, especially, where it is written in the Book of Romans. The Book of Romans was suppose to demonize the social practices of Rome. It most certainly did exactly that.

In the passage of Romans I, line 27, there was a lot of social practice that included all sorts of sexual pleasures including
eunuchs as servants. Creating a eunuch from a man was not only dehumanizing it was dangerous to the person's health and also a human rights violation. The Romans didn't care about human rights. At all. They were a society based in conquest. Rome itself would have fallen far earlier if it hadn't conquered Egypt.

But, the point here is that Paul wrote these passages to defeat the polytheism of Rome and break down the power of the Emperors in order to have a paradigm shift. This passage uses 'gender' to raise the sexual practices of the Romans to the level of 'SIN.' It has nothing to do with godliness or procreation or any of the values that the Religious Right proclaims this passage to be about. In actuality, the passage has absolutely no relevance to a free society where people live within the understanding of 'equity.'

Basically, the Evangelicals are liars. They are simpletons that USE Biblical passage for their own purpose without AT ALL educating their flock. Their use of this passage is pure bigotry and nothing more. The ONLY deciding factor of any sexual being is based in genetics. There is nothing evil about being gay. Nothing. Get over it.

It seems so apropos for the Religious Right to propagandize their hate based in this particular POLITICAL passage. I find it hysterically funny that Paul is still alive and well in the Religious Right after his conquest actually succeeded, especially considering the eunuchs would be the end of the Roman Empire as the Ceasar like lineage would remember it. The Eunuchs wanted freedom. I am sure the Gay Community finds nothing funny about it at all.

This entire situation in the USA is hideous beyond belief.

If the lies don't serve the purpose then change them. Beck strikes again. The savior of all savirors, Glenn Beck.

Glenn Beck will lie out of both sides of his mouth to keep the attention on his demented campaign to cause opposition to CIVIL SOCIETY.

Today he stated, Olbermann was wrong in his understanding of what is meant by death panels.

Oh, really?

Well, he isn't because it was only the summer of 2009 when everyone, including people like Beck and the Republican Senators were screaming "They are going to pull the plug on Gramdma." That WAS the quintessential definition at 'that moment' that was 'working' to cause hysteria and anger with gun toting Tea Baggers at Town Hall Meetings.

NOW. It is obvious there is no 'Pulling the Plug on Grandma,' the definition HAS TO CHANGE.


So, in the world 'According to Beck,' the definition of 'Death Panels' takes on a far broader definition that HOPEFULLY, President Obama can't 'wiggle' out of this time. The definition this week is that when a person turns age 65 or some random age, maybe even 35, they won't be able to get knee replacements.

Everyone knows that is called 'rationing' and every knows it occurs today in our American society.

The problem with the 'communication' issues from the Right Wing of the country is that they need to publish a dictionary. Maybe if the rest of us, whom really do want to be a country rather than a party, can read a definition and apply it to any statement there might be a common understanding.

Being SLICK isn't easy for Beck, but, he is treading water as fast as he can to maintain 'SOME KIND' of political posture.

The Health Care Insurance Reform measure needs to move to Reconciliation and need to move there soon. The Democrats are obviously alone in moving the measure forward. It was noteworthy as to what everyone did agree on yesterday, but, there was no real 'new' ideas. Starting over would have been a real consideration, IF, those that wanted to start over actually had a reason to do so. They didn't. There is no magic here. There is simply writing a bill, passing it and having it submitted for signature by the President of the United States of America. No 'bright light' is going to descend from the sky to 'light the way.' We need to move on.

Yesterday was a Summit. It was suppose to bring the issue to a pinnacle of resolution. It wasn't a political gaming session. If nothing productive came out of it for the political ambitions of Republicans, then it wasn't suppose to and that is the really sad part.

That is EXPONENTIAL growth, honey. No system of ANY kind can sustain under exponential growth. It is not possible. The health care system will COLLAPSE if there isn't something done about it, NOW ! Alexander is incompetent. The Federal Government has to handle health care, it is not OPTIONAL.

...hm....unless....of course, the GOP wants to dissolve the sovereignty of the country and hand it over to corporations. What do ya say? Good idea?

Oh. Wait. We have a lien against the USA that the GOP exponentially ran up during the Bush/Cheney years while the Republicans fought an illegal war in Iraq. Oh, that's right. I guess China has first option to buy before any corporations do.

I can understand why China is more than miffed at the actions of the USA government in recent months, especially when it comes to Taiwan, but, China has a problem to solve. That problem is North Korea. It is unrealistic for China to bark angrily at the USA about rolling up the welcome mat, when the countries in the region are threatened by North Korea's nuclear capacity.

What is the USA suppose to do, keep its fingers' crossed in anticipation that North Korea won't launch against Japan or Taiwan? What makes China so sure that North Korea is as 'in control' as it wants the world to believe it is.

North Korea openly distains the USA and wants to achieve the ability to launch nuclear missiles against the West Coast of the USA, if not DC or the interior of the country if it can. What would be a 'bigger and wetter kiss' to the USA from North Korea, but, to actually launch against Japan or Taiwan?

I would think China would be on the same page as the USA over this and see the benevolence of protecting Taiwan from North Korean hostilities.

I actually don't see this as an agressive act against China. I mean get for real here. Where would China even be with its space programs without the USA? I think China needs to 'rethink' its position in regard to the insecurities of Taiwan and Japan right now and GET REAL with North Korea. China is trading insults with the USA without resolving the PROFOUND security issues on the Korean Peninsula.

Hello? Sorry to be so brash, but, after all what the heck is everyone thinking?

I don't recall anyone dissolving the One China Policy. Yes?

There are still many questions in the face of obvious natural behavior by this Orca. Those behaviors are noted in the wild when two Orcas are noted tossing a sea lion pup between them only to abandon it to its mother on the beach.

No trainer should ever be so sure the animal, whom's natural instincts they draw on to facilitate communication, is ever so removed from their instincts to feel they are safe from them.


Sea World has job to do and policies to review. Their trainers are very dedicated in order to 'stay in tune' with the animals they work with for the public to come to interact. It is that 'dedication' that placed Dawn at risk today. The 'bonding' is important, but, when she recognized an aggitated behavior by the Orca, it should have been a warning and NOT a call to action to try and calm him. With aggitiation, he should have been removed to a holding area and sedated until better behaviors were noted.

Tomorrow is the Day the Wrinkles are ironed out of Health Care Reform


Underinvestment in prevention and public health. Too many Americans go without high-value preventive services, such as cancer screening and immunizations to protect against flu or pneumonia. The nation faces epidemics of obesity and chronic diseases as well as new threats of pandemic flu and bioterrorism. Yet despite all of this less than 4 cents of every health care dollar is spent on prevention and public health.8 Our health caresystem has become a disease care system, and the time for change is well overdue.

This is a mainstay of a healthy and happy America. Preventive Care has been the salvation to many, many people. I survived cancer because of Preventive Care. The cost of saving my life was far, far less because of early detection. There should be no reason in the USA for any citizen to feel alienated from 'the right to be and feel healthy.'

I read a story recently about a man, an artist, that died because of an infection under his tooth. He was playing physician to himself because he didn't have health care. I am sure anyone interested in the topic of health care insurance reform has heard the nightmare sceniaro of the child that died of an infected tooth. The child did not have preventive dental care and when it came to seeking a dentist when there was pain it was too late. The emergency room became the venue of treatment and the child died. He died in the United States of America because his parents could not afford a dentist and a simple perscription to save his life.

For health care practitioners working with stroke victims and paralysis, there is a syndrome that accompanies such diagnoses. The syndrome is called 'The Disuse Syndrome.' It is a nursing diagnosis as well as a physician assessment issue. The syndrome basically states that due to lack of sensation and movement a limb(s) are ignored by the person afflicted with the paralysis or impartment. This is a physical diagnosis as there is muscle deterioration and potential for joint malformation and skin integrity problems. It isn't really considered a psychological issue as a person has to learn they are ignoring a part of their body that was once very useful.

At times, I wish the diagnosis could be applied to social functioning when people interact with the health care system in the USA. See, I believe people that are 'at risk' for serious health issues and burgeoning death 'syndromes' surrender their ability to 'use the system' when the reality of the lack of access to health care becomes obvious.

One would expect people that are discriminated against in obtaining and maintaining health care insurance or access would be fighting mad and wouldn't take it anymore, but, they don't. They literally lie down and die.

Penguins do that. Adele penguins in Antarctica when faced with ice formations that block their amble to the sea to eat and find fish for their young, simply lie down and die. They don't problem solve. The Adele's don't know how to problem solve. The occurrence of a blocked path to the sea is too much, too huge for them to overcome their natural instincts.

People become that way. They become defeated in understanding their dilemmas and they 'give up.' They figure they can problem solve disease and infirmity themselves and find solutions that will result in a 'good enough' outcome. No adult or child or parent ever believes at the end of their ability to cope with life and its hardships lies a coffin. Not in the USA. That simply doesn't happen here.

But, it does. Every day Americans die. Old Americans, young Americans, middle age Americans and American Veterans lose their 'insight' to life, become despondent and die. They don't make a big fuss and clamor for attention so that those surrounding them 'rescue' them in the nick of time. They 'resign' themselves to a failed life as if a punishment for the lack of success to have what '? everyone ?' else has. That is about the saddest reality a society, a First World society, can assess of itself. A population could be wiped out that way. In the history of humans on Earth it has happened exactly that way.

The health care issue is huge. The USA needs to rally around the potential for improving its MORALITY and supporting its people to a new reality. Every American deserves a life of wellness. They deserve a life with Preventive Medicine. Every American needs to feel empowered enough to seek PROPER medical attention for 'what ails them.' Health Care Insurance Reform is more than just adjusting 'the cost' to Americans, it means as a nation we are empowered to act in our best interest to obtain and maintain wellness.

Rates of chronic diseases have skyrocketed in the last 2 decades.17 (these number appear all over the Executive Branch's Health Care Proposal. They are reference numbers. Those numbers are found at the bottom of the proposal. That means the reference is there to VERIFY what is being stated as fact. It is a form of respect to the reader. The Executive Branch has no intention of lying to the people reading their proposal and what to prove they have considered all the facts.) Over 133 million Americans have at least one chronic disease.18 With proper care, the onset and progression of these diseases can be contained for many years. In addition to the needless suffering and early death they cause, these chronic conditions cost a staggering $1.7 trillion yearly.19 Barack Obama and Joe Biden will support providers to put in place care management programs and encourage team care through implementation of medical home type models that will improve coordination and integration of care of those with chronic conditions.

Chronic disease is a big issue in the USA. It is expensive to maintain care to those that are chronically ill, however, the Executive Branch of the USA has a plan that will put in place 'therapy regimes' (including home care) that will ward off debilitating aspects of chronic disease. In putting 'therapy regimes' in place it will cut costs of treatment and people will have expected outcomes to those therapies. Where a person 'falls off' the expectations of those regimes, there can be assessment as to why. It is more than admirable, this issue has an exclusive recognition in the proposal. It tells me the Executive Branch has done its homework and knows where high costs of quality care exists and will be focusing on these issues to monitor cost and improve performance.


Barack Obama and Joe Biden’s plan strengthens employer–based coverage, makes insurance companies accountable and ensures patient choice of doctor and care without government interference. Under the plan, if you like your current health insurance, nothing changes, except your costs will go down by as much as $2,500 per year. If you don’t have health insurance, you will have a choice of new, affordable health insurance options.

That all sounds really nice, huh? But, how do the American people feel reassured they will actually have all this working for them? Because it is obvious the Executive Branch have done their homework and seek to 'standardize' care across the country. A CARE STANDARD that carries with it the brevity of the legislature means that all insurances will help Americans in the same way. Everyone in the USA will have dignity in deciding what plan they want knowing their 'care standard' is not compromised in their choice.

I am looking forward to having every person well and happy and living a life worthy of the USA. I hope everyone else feels the same way.

There's a high-tech experiment going on in New Hanover County.

It includes radios and video cameras and sensors and computers.

And it involves “TV white spaces,” the unused television frequencies that resulted from the 2008 transition from analog to digital transmission of TV broadcasts.

During the next several months, TV Band Service LLC, of Wilmington, and Florida-based Spectrum Bridge Inc. are testing the nation's first “smart city” wireless network in New Hanover County using TV white spaces....

When a company wants to find out how much consumers CAN BE MADE to tolerate in the market place there is a methodology to it.

This type of 'consumer testing' happens a lot in the Wilmington, NC. The people in that city think it is some kind of honor to be involved in this mess and that should tell people something.

Wilmington, North Carolina is home to UNCW, a coastal university in the UNC system. The students that attend there are among the highest achieving students in the nation. They are chronically defamed and complained about by 'The Big Talker Curtis What's his name, oh, yeah Wright." He is always complaining about their driving. What he is really PO'ed about is the fact there are higher car insurance rates in that city due to the higher accident rate. He doesn't tell people that are citizens and listening to the program that there are also a lot of drunks in the "Port Party City."

But, demographically, Wilmington, North Carolina basically has no economy and hasn't for a long time. The City Mayor and Council are pathetically corrupt and the people that vote them in are simply doing it because they SEEM SO NICE. The 'agenda' of local politicians and the construction lobby is to 'ride the behind' of the university Chancellor to build all sorts of concrete structures to line their pockets, whether the university needs it or not. See, the poeple of North Carolina believe in education as a HOPE to improving the lives of their children, so they don't have to work two jobs, babysit a dozen kids every week and deliver newspapers to make ends meet. That is how 'dirt poor' that city is EXCEPT for the 'fat cat' politicans and construction lobbyists.

But, there is a 'characteristic' about people 'assigned' to poverty that capitalists seek. To begin with they watch a lot of television and listen to radio because they don't have a life otherwise. It is why one of the Tea Baggers came from Wilmington and the Big Talker listening area. But, that aside, these folks are 'hungry' for opportunity that will get them out of their rut. A long and deep rut.

The other thing is that people who have a lot of time to watch TV and listen to radio are also 'social thinkers.' Their 'social mind map' encompasses a larger 'view of the world.' They like to be 'involved' in activities that seem to 'find purpose to those daily activities.'

So, it seems as though Wilmington will once again HOST the Olympic event of determining how best to exploit the public when it comes to 'REASSIGNING' analog wave lengths to new commercial opportunities. There is gossip going around that AT&T has bought the lion's share of these analog wave lengths. I guess.

But, I thought it was interesting for everyone to realize exactly how exploited they are. The American public has lost the potential to have RABBIT EARS on the television, be required to subscribe to cable only to have this so called 'antiquated' way of moving 'information, news and entertainment' RE-EXPLOITED so that these wave lengths are now controlled for market purposes. In other words, the American consumer was 'kicked off' the FREE method of receiving TV signals so some 'Gosh Aweful' Capitalist can exploit them.

KINDLY remember, this mess happened under the Bush/Cheney administration. Okay?

So, get ready. The American Consumer is about to be fleeced AGAIN ! And the 'test marketing' to the fleecing begins in Wilmington, North Carolina where people believe they are more valuable in front of a TV and at a radio signal than anywhere else in the country.

The body of Marine Corporal Gregory Stultz will return home for the last time Wednesday.

The Brazil native was killed in an ambush late last week.

The family says the body will be flown to Terre Haute Regional Airport at approximatley noon Wednesday. His remains will then be escorted along State Roads 42, 46 and 40 to the French Funeral Home in Brazil.

The funeral will be held at Christ Community Church in Brazil.

DOD Identifies Marine Casualty

The Department of Defense announced today the death of a Marine who was supporting Operation Enduring Freedom.
Cpl. Gregory S. Stultz, 22, of Brazil, Ind., died Feb. 19 while supporting combat operations in Helmand province, Afghanistan. He was assigned to 3rd Reconnaissance Battalion, 3rd Marine Division, III Marine Expeditionary Force, Okinawa, Japan.

To begin with this Proposal is a casual document. It is a proposal and not a bill. There is nothing legal or binding to it EXCEPT it is issued by the President and Vice President of the USA and carries the brevity of those offices.

In other words, it is meant to be taken seriously and not simply as a political volley.

The Executive Branch produced this proposal to begin a process that is suppose to culminate in PRODUCTIVE measures at the White House Summit on Health Care.

That's the title. None of this is a simple or inconsequential matter as it can effect the wellness of every citizen of the country. The Executive Branch is attempting to 'move this issue along' because IF it is not addressed SOON, it will not only cause great hardship to the American people, it will destroy any fragile recovery that is now underway in the USA economy. The issue HAS to be resolved and soon.

Health care costs are skyrocketing.

There are some interesting statistics within this paragraph. I am not going to quote them, but, they say basically what most Americans understand about health care insurance. The companies that deal in this commodity are out to make a profit and while that is what drives the USA economy, there has to be a fine balance between the profits HEALTH CARE INSURERS make and the benefits their clients receive.

It is NOT like Life Insurance. Life Insurance is a single issue in the lives of folks. Either the insured is alive or dead. That's pretty simple.

Health Care is completely different. The QUALITY OF THE INSURED'S LIFE is the issue and where that is not adequately addressed the insured does die. If that death is caused by the INSURER, then there is a "Breach of Contract."

- Death is NOT suppose to occur and when it does because of denial of benefits due to 'so called' experimental medicine that is a CHANCE to save a life there is something grossly "W"rong. In any understanding of medicine and/or surgery there is a profound definition that goes along with it in that an MD 'PRACTICES' their craft. That means if an MD states there is a new medicine currently issued by the CDC that is considered 'INVESTIGATIONAL' and is believed to produce a benefit to extend life (as Chemotherapy does) or save life then that is a valid treatment. End of Discussion. There is no Health Care Insurer that is suppose to be PRACTICING medicine and denying coverage of valid orders by MDs. That is MALPRACTICE of the license to insure. Even if a Health Care Insurance Company has an MD on staff it doesn't mean a DAMN thing. Their client has a physician that is treating them and allowed to receive the benefit of payment under their insurance policy. If there are unreasonable clauses in the policy then the State Licensing Board is not doing its job. The CDC does make decisions regarding investigation drugs and treatments lightly. There is a lot of taxpayer monies that go into these classifications by the CDC and there is no authority in existence that has any right to refuse the treatment to patients offered as 'HOPE' to a citizen. The people of the USA have stated loud and clear we want to LIVE. Not only do we want to live, we want EVERY chance that our scientists and doctors can give us and we have put government authority behind that understanding about life. Therefore, when the CDC comes out and states, there is reason to believe a medication has potential to save lives and we do not have any reason to believe this is a harmful measure that carries great brevity in the medical and surgical community. Doctors and Surgeons want to help people and when there is new hope they want to practice that hope. ANY Insurer that stands in the way of that is practicing against the wishes of the American people and should be eliminated as an insurer at any State Licensing venue. End of this discussion.

- If that death occurs because of the lack of access while folks are insured that is in my opinion WRONGFUL DEATH. If people are denied access to health care while having health care insurance, those denying them access are liable. No one should be denied access and this entire idea of 'in network' or 'out of network' is one of the most hideous concepts in any contract written. Literally, people could have a health care policy that list dearly few 'in network' practitioners and no specialists and they are excluded from care. Unknown to them until it is too late. The 'in network' or 'out of network' contract issue is an Insurers dream come true, it is a money making deal and it discriminates against any practitioner that is licensed by any State. It is a form of fraud and is a BARRIER to care. It is illegal and should be eliminated by State Licensing Boards. If a practitioner is licensed they are valid to receive payment by insurance companies. END OF THAT DISCUSSION.

- If death occurs because a person has been denied coverage because they have a pre-existing condition, THAT in my opinion, is gross malpractice of the insurance laws of any state and also is extremely poor management of an insurance company.
Any state that allows such practice within its borders is threatening the lives of its citizens and has issue with human rights. Pandering to health care insurers so they can 'gain' profit by accepting CERTAIN citizens is discrimination. The SICK and/or those that have been SICK is what health care insurance is all about. The insurance exists for the UNFORTUNATE need that an insured needs help. Hello? To state those afflicted by the 'very reason' these CORPORATIONS exist are allowed to be ostracized of benefits is not only conflict of interest, it is fraud. One cannot state, "We are going to insure people in case they have health care needs" and then not do it and still have a license. The 'contract for payment of insurance benefits' has become an instrument of fraud and deception. In order for people to understand their RIGHTS under the contract, they have to now obtain prior authority from the insurance company to save their own lives. That should not be happening under any insurance laws that issue licenses in any state. There is no PRE-CONDITION to saving lives in this country, yet, the very 'lifeline' people pay large amounts of money they earn to have THE RIGHT TO LIVE in the USA is an instrument of fraud through the contracts allowed by the licensed practioners of health insurance. That is outrageous and extremely egregious of the Public Trust. Since when is the STATE a partner to the death of Americans?

DEATH by Insurance is not an option in this country, however, it is a reality.

That is not only malpractice of the licensed insurance companies it is extremely poor performance by these companies managers. It is not only bad PR, that they don't care about because of their power over people's lives, it is a lot of money uncollected to their companies stockholders.

In 1997 I was diagnosed with Cancer. It was successfully treated with surgery. Two day in the hospital, about 30 minutes under the scalpel of a trained and experienced surgeon, about 2 hours with OR and PACU staff to take me into a stupor to allow the surgery and then bring me out of it safely and then two days on 'the floor' to insure I received sufficient IV fluids to rehydrate me and establish my 'homeostasis' was stable in order to be discharged.

The bills were paid and I am fine. That was nearly 13 years ago. Thirteen years of premiums that more than paid for the INVESTMENT that health care insurance company made of me to save my life. I would have died otherwise. Thirteen years of simply vigilance and wellness programs that would not necessarily cost me what premiums cost me and my insurer/employer.

I have a friend that runs a transportation company. Fancy name for trucking firm. He runs trailers out of Port Elizabeth, New Jersey. He needed a driver for one of his tractors. This guy applies. My friend is a devoted Christian after several years of drug addiction. He is a successful business man now with a wife and child. Happy guy. So, this guy shows up looking for a job. He is very experienced. Lots and lots of road experience, but, he is unemployed. My friend is attracted to the application, it is an exceptional application for his size operation and interviews the fella. He asks is there anything I need to know that you care to tell me that might effect your employment in a way that I might misunderstand. Interesting question, huh? Remember, my friend is a recovered addict. He isn't interested in the 'status quo' application, okay? Also remember, he is extremely successful in his business. I mean successful. Private boat and all sorts of toys. The man applying for the job didn't have to say another word. He was about to be hired, or so he thought and he wasn't required to tell my friend anything else. But, he did, because he wanted a friend, too. An employer that would appreciate him as a human being and not just a number on a flow sheet. My friend could be considered a small business owner. This one time long-haul truck driver was in renal failure and went to dialysis three times a week. He was on a list for a kidney transplant and his attendance to his health needs might interfer with his work schedule. My friend hired him and scheduled him for work on the days when he was not receiving dialysis. He provided health insurance to him and when the day came for his transplant my friend took the run and looked for another drive, BUT, only until he was recovered and received clearance from his doctor to return to work. That man did not miss one day of work, worked what was asked of him and attended the small holiday parties at the house. He and my friend are not only acquainted with each other they are good friends. My friend stated to me, "one life saved, like mine was saved."

THAT is an American. We give a damn about each other and will watch each other's lives in vigilance of the outcomes. We don't need insurance companies that don't do the same thing. There is no reason for any insurance company in the United States of America to refuse treatment by any MD order. None. There is no good reason for refusal of coverage or enrollment. Any manager currently engaged in such a practice is in violation of any clear understanding of human rights in this country and should have their licenses pulled. I don't want to hear how Americans are being cheated out of life saving measures, even if that means having root canal on an infected tooth. There is no reason for it, except managers that carve out artificial short term gains for bonus dollars over the long term reward of managing a respectable company.

Americans have been abused by health care, period. They have been abused by the CEOs of heath care and I don't care if it is the CEO of health care systems. Those CEOs of Health Care Systems throughout the USA seem to believe they have to accept insurance company contracts over that of the demands of their physicians and patients. They are as much a part of the problem as the insurance companies themselves. CEOs of health care systems pander to insurance companies when they should be refusing to do business with the wealth merchants. The CEOs of Health Care Systems want to paint themselves as 'saints' to the 'sinners of health care insurance companies' and need to make necessary cuts in their budgets in order for their patients to receive care. Huh? Since when do the people that provide the services answer to those that seek to make money off those services. Since when are patients and physicians pawns in the market place of wealth merchants? The relationship is backwards and should not be rewarded. The health care systems, ungainly as they are, have the commodity. They set the price, they allow the insurance and they moderate the outcomes. NOT, the other way around. When a patient is given 'health care' it should be timely, appropriate and in measure that matters, not ONLY WHAT IS ALLOWED. When an MD makes an order, those 'in service' to the order need to ask how high they have to jump and not how high the ? patient ? has to jump. No, no. I don't think so. Patients are in NEED, physicians are in PRACTICE and those that MANAGE the insurance and facilities need to be in servatude. End of that discussion.

Americans die from medical errors in hospitals every year.3 One-quarter of all medical spending goes to administrative and overhead costs, and reliance on antiquated paper-based record and information systems needlessly increases these costs.4

Peer review and licensing issues for malpractice and neglegence INCLUDING a review of the Health Care System and their failings in providing 'error free' venues of care. In other words, the medical errors that occur have a reason and they sometimes occur due to the management of the 'care environment.' What I mean by that is addressed in understanding that physicians practice and have to practice in large health care systems where 'cutbacks' and all sorts of 'staffing' issues, including, under staffing exists. That is due to the 'backward' reimbursement systems and the profits made by CEOs all along the line. Health care is provided by human beings. There is no better way of doing it. A person is a unique living entity with a history and assessment at the time of need. That assessment and understanding of a patient's health history has to be conducted by physicians. It just does. As a result there are issues that fix certain understandings that human beings do not have endless capacity to deliver 'good care' in any environment offered to them. They can, ie Haiti, but, the American 'delivery' system should not be viewed through its 'finest hour' in Haiti as a daily diet. That is unrealistic. If that were the case all surgery in the USA would be done in tents to save on electricity and provide more patient rooms rather than surgical suites if CEOs had their choice. That is an extreme example, however, it underlies the 'reason' why medical errors can exist. When a practitoner of health care is brought into question regarding their license what also needs to accompany that (BY STATE MANDATE) are statistics and quality assessments of the care environment where the errors occur. What I am saying is that errors are simply the tip of the iceberg and calling 'health care delivery' into the picture will 'fix' the issue far quicker than simply taking it 'case by case.' If the Peer Review system of regulating poor practitioners continues in the venue it is today, it will result in nothing more than a revolving door of people. It isn't a good review system without that component. It will call into question the CEO choices to the 'care environment' that effects any practice at any level. That said, changing 'record keeping' to computer systems may help to make the practice quicker and more efficient IF that ever reaches the pinnacle it is intended to achieve, HOWEVER, it is not ONLY the computerization that will eliminate the issues. It will only resolve ONE 'care environment' issue. It won't matter if the computers are working well if the HUMAN BEINGS at the end of the computer are overwhelmed with an unsatisfactory 'patient ratio' and/or 'hostile care environment.' The entire 'delivery system' has to be PEER reviewed, given the way it has been sadly effected to date.
