Their so called "strength" in changing direction on Roe v. Wade based in their religious fervor and professional affiliations with the Federalist Society (click here), is based on vocabulary words and not the experience of the American people.
We all know that women seek abortions regardless of it's legality and they fall into the hands of backstreet butchers. Those are the facts regarding the presedent of Roe v. Wade. If the Supreme Court changes direction ON THE SCIENCE that means this is offically a Banana Republic.
Law isn't about words, as the Crackpot Conservative judges believe is their right to manipulate. It is about citizens. The law is always about people and primarily it should protect in all its words the rights of innocent citizens. There are laws that are supposed to protect citizens in the practice of business and in protecting their very lives. But, what we know is that there are two sides to every story and that is the beauty of the USA Constitution. It is not absolute in it's authority as demonstrated by the Fifth Amendment and the right to Due Process.
The most dramatic example of "fairness" in law is exactly at the time of sentencing of a murderer. People from past come forward to speak to the crime the murderer committed. Due to that aspect of sentencing the law tempers the punishment to fit the crime.
A good example recently is the attempted coup on January 6, 2021. The people are stating they were asked by the former president to overturn the electoral process to prevent the peaceful change of president. The people of those CRIMES are going before judges and coming away with varying sentences. Some strong and some weak, but, many of those involved in that uprising to benefit Trump were from "normal" backgrounds. The weaker assignment of law to some of the people is due to the fact this is their first unlawful act and confess they did it for the wrong reasons. Basically, they are telling the judges they are sorry for their misconduct and it will never happen again. The judges have no reason to dismiss those pleadings.
But, as to Roe v. Wade.
To begin, a fetus is not a human being or a citizen of the USA until it is born. Fetuses cannot obtain viability until 24 weeks at the earliest. At that point there are some state laws that allow an abortion clinic to bring a viable life into the world and place it on life support to allow a neonatal unit to complete the growth of the fetus. Upto that point, a fetus is not viable and therefore it is the woman's body that has the strongest majority of rights at that point. A woman's body should always come first before a fetus. Always, without exception. There have been some dramatic births of women killed or dead due to accidents and the babies are still born to their families.
No girl grows up thinking there is a potential of dying from childbirth or carry a pregnancy to term because a law is judging them morally according to church doctrine. A girl has dolls to play with thinking this is the happy moment my Mommy had with me. When women become pregnant by MISTAKE that does not mean their lives are changed forever, because, there is no hiding a full term pregnancy and their lives can be adversely effected from that reality alone. If the pregnancy is unwanted then it is the right of the woman to end that pregnancy as it is a medical condition that will have it's way with her, both physically and emotionally. Unwatned pregnancy can have a strong negative impact on a woman's life.
I don't want to hear, but, they can give the baby up for adoption. That happens regularly. Children are abandoned to orphanages until they are adopted, if at all. If that is the choice of a parent to give up their children for their own reasons, that is legal in the USA. But, all to often when women speak about the children they gave up for adoption, they conclude that the "not knowing" is always on their conscience. So, even when children are surrendered for adoption their presence in the world is still felt by the birth parents. It is a rare occassion that a birth parent simply doesn't care about knowing the child at any time in the future. We always hear about child finding their birth parents and it is a cathartic to them. Really? I didn't know the child was wounded.
Roe v. Wade removed the idea that laws could minister moral judgement on women. It allowed a woman to own her life autonomously and even if in a bad marriage whereby she faced or faces abuse on a regular basis.
The American people love pregnant women and love babies when born, there is no reason for a law to judge a woman about her willingness to give birth to a new citizen. A woman has a right to maintain her health and well being from any condition that could alter her happiness and/or her life and lifestyle. It is not easy to go through a pregnancy alone and quite frankly, to solely carry a fetus to full term if 280 days or 40 weeks without a spouse or partner is difficult. There are times, especially with other children already in the family, that life becomes impossible to manage alone.
So, the issue of Roe v. Wade is enormous, including judgements against parents for child support. It is about women and their right to their own bodies. It is about privacy between a woman and her doctor. Ultimately, it is about the burden of an unwanted pregnancy and a woman's happiness. Women are allowed to be happy and have a family and/or career, but, it is their choice and no one else's choice. That is enormous and is the promise of the democratic freedoms guaranteed to all Americans.
There are currently no reasons to review the precedent of Roe v. Wade. It is settled precedent and should remain so.
