The Michigan Supreme Court (click here) heard oral arguments Wednesday on whether defendants in the Flint water criminal case were denied a key constitutional right. If they win, charges against defendants going all the way up to ex-Gov. Rick Snyder could be thrown out.

The specific issue before the court is whether three of the defendants were denied their right to a preliminary hearing. The preliminary hearing is where prosecutors have to show a judge they have enough evidence to take a case to trial. But the government says that step’s been covered because these charges were brought in this unique process where a judge acts as both prosecutor and grand jury.

The state’s lawyers focused on the argument that even if it’s unusual, the law allows for a one-judge grand jury to decide whether to charge or not to charge.

Assistant Attorney General Christopher Kessel said the Flint water case is an unusual situation “…where the allegations of government corruption at the highest level do result in the victimization of an entire city. Now, I appreciate that defendants want to have a preliminary exam, but defendants are not entitled to choose their right of prosecution.”

The defendants are former state Health and Human Services Director Nick Lyon, who is charged with involuntary manslaughter. Former state health official Nancy Peeler is charged with misconduct in office and willful neglect of duty. Richard Baird, a top adviser to then-Gov. Rick Snyder, faces charges of misconduct, perjury and extortion.

Defense counsel Harold Gurewitz represents Nancy Peeler. He said the preliminary examination protects defendants’ rights....

Casey Cole White is at large and is very dangerous. Alabama needs help in apprehending him.

A gay couple was faced with his brutal ability to kill. They are describing him as another Charles Manson or Ted Bundy.

The authorities need INFORMATION. They can very well do the apprehending. It is ill advised for anyone to confront the couple so much as call police with information.

“He will literally do anything and everything, including killing, including kidnapping, including killing animals and putting children in danger, to get what he wants,” Charles Abernathy told The Post late Thursday. 

“And of all people to escape, this dude is probably the worst level that you could possibly let escape.

Secretary of State Brad Raffensperger (click here) supports a last-minute bill the legislature passed giving the Georgia Bureau of Investigations jurisdiction over election fraud allegations, he said Thursday at an Athens Area Chamber of Commerce event....

A judge in Georgia on Friday found that U.S. Rep. Marjorie Taylor Greene (click here) is qualified to run for reelection, concluding that a group of voters who had challenged her eligibility failed to prove she engaged in insurrection after taking office. But the decision will ultimately be up to Republican Secretary of State Brad Raffensperger.

Before reaching his decision, state Administrative Law Judge Charles Beaudrot held a daylong hearing in April that included arguments from lawyers for the voters and for Greene, as well as extensive questioning of Greene herself. He also received extensive briefing from both sides.

State law says Beaudrot must submit his findings to Raffensperger, who has to decide whether Greene should be removed from the ballot.

Raffensperger is being challenged by a Trump-backed candidate in this month’s GOP primary and would likely face huge blowback from right-wing voters if he was to disagree with Beaudrot’s finding...

"We want Ukraine to win this war."

Ukraine has the moral high ground. There is no doubting the mission it is on. There is only one path forward and that is to insure the survival of the Ukraine people and end the siege of their land. There is no other path. What Russia has done is unconscionable.

Ukraine didn't like the occupation of Russia in Crimea or Eastern Ukraine, but, they accepted it to avoid the exact war that Putin has brought to them. They didn't want this. They wanted to be an economic partner to their neighbors. Putin has now made that impossible at least in the short run.

The country of Ukraine has no responsibility for this aggression. This is Russian aggression on people who considered themselves neutral. The world has an example now of the imperialism Russia has planned, not just for Ukraine, but beyond this genocide. Vladimir Putin is wrong. There is just no doubt to that fact. The only remaining countries that can act to protect Ukrainians and assist in defense of the country are the countries of NATO.

It is Vladimir Putin's war and it is unjust while he kills enormous numbers of innocent people.

Budapest -Hungary (click here) cannot support the European Union's new sanctions package, which includes an embargo on oil imports, in its present form, Prime Minister Viktor Orban said on Friday.

Orban said the European Commission's current proposal banning Russian oil imports would amount to an "atomic bomb" dropped on the Hungarian economy, adding that Hungary was ready to negotiate if it sees a new proposal that would meet Hungarian interests.

The European Union's executive on Wednesday proposed the toughest package of sanctions yet against Moscow for its war in Ukraine, but several countries worried about the impact of cutting off Russia oil imports stood in the way of agreement.

A handful of eastern EU countries are concerned that the halt would not allow them enough time to adapt, even though diplomats said Hungary and Slovakia would be given until the end of 2023.

Orban told state radio that Hungary would need 5 years and make huge investments in its refineries and pipelines to be able to transform its current system which relies about 65% on Russian oil....

Wars and alliances are not a matter of convenience and Orban needs to stop his bellyaching.

On 8-9 March 2022, (click here) the Chair of the NATO Military Committee, Admiral Rob Bauer was in Hungary where he met with the Chief of Defence, Lieutenant General Romulusz Ruszin-Szendi, visited a border crossing with Ukraine and attended the Exercise Eastern Shield....

Not to state Hungary has abandoned it's responsibility. That is not the case. It is fully invested in the defense of NATO, but, it is time for it's leadership to take the defense of their land and enter into sanctions that will act to end the brutal war engaged by Russia.

An alliance is as strong as it's weakest link and Hungary needs to do it's part to end the infusion of income to Russia that will empower it further against Ukraine and NATO. This is genocide. This is not a border skirmish. Orban needs to get on board with sanctions and ask other alliance for advice as to how that gap in energy needs will be replaced to maintain it's economy. Simply walking away from EU sanctions is not in the best interest of NATO or Hungary. Orban must comply. The alliance will not abandon Hungary in it's struggle to find energy other than the fossil fuels supplied by Russia.

 

Please check the surrounding buildings for soundness. Blasts go further in their damage than what is seen.

Mayor Silva is the second person to report there was a gas explosion.

Alexis Acosta Silva, (click here) mayor of Old Havanna, believes a liquified gas bullet tank was being installed in the hotel. There was a reported crack in a supply hose. Five people have died and there are injured, currently two in surgery for broken legs and two in surgery with skull fractures. Eight other people are in intensive care on ventilators with at least 12 people missing or unaccounted for.

I don’t want to hear about USA assistance to Ukraine.

There one word that allows the USA and any other country that stepped up to help Ukraine.

GENOCIDE.

The West took the ONLY path they could.

Associate Justice Alito is wrong and incompetent on a legal level. He should be impeached.

There is a tragedy here with Alito, he is grossly out of line with the USA Constitution and he needs to be impeached for his imcompetency. President and First Lady Obama are working hard to encourage voting, but, they can't deal with the corruption that is underway to suppress the vote of 2022. That has to be addresed by the Justice Department and US Attornies. I wish the Obamas would apply their genius to impeaching Sam Alito. It is going to take hearings to bring home the success of such an impeachment.

Look, Alito is causing such trauma across the USA at a time when it doesn't need it after facing an assault on the US Constitution which includes Republican members of Congress running for the safest political stance because of Trump's influence in the Republican primaries. They are cowards. Democracy is under attack and there is no other country aware of it more than Ukraine and it's neighbor NATO. 

That said there is a dearly BASIC understanding of the USA Consitution completely ignored and almost desperately by Alito. He is completely incompetent. Ask oneself what allows the USA to GROW it's Constitution to come into compliance with an ever changing world. There is one aspect of the USA Constitution that makes it the strongest democratic document on Earth and Alito completely dismisses it and egregiously so.

This is basic stuff. What makes the USA Constitution a flexible document that grows with the people and it's ever expanding culture? Come on now. Put thinking caps on and get this over with.

The Founding members of the USA society in the first thirteen colonies NEVER trapped Americans to live in the 18th Century. Never. They loved democracy so much that they provided a way to bring about a US Constitution that could live on for generations, even the centuries that is has survived.

Got it?

Article Five of the US Constitution allows for Amendments and has absolutely no limit to the content of the amendments. The only aspect of Article Five that is rigid in understanding is the 2/3 number of federal legislators and 2/3rds of states must approve it. It may be 3/4 of the states. But, that is irrelevent. Article Five provides "STRICK CONSTRUTION" to passing an amendement and not limiting it's context.

End of discussion. Incompetency has to be addressed.

Deep within the democracy the original signators of the USA Constitution provided was a method to MODIFY the it to improve the lives of Americans for millenium if the country and Earth's climate allows it. ALSO, there is a measure that allows a "Constitutional Convention" to completely rewrite it.

The founders of the USA Constitution in love of democracy and freedom openly stated the document was delicate enough that it was up to the people to "keep it." I think that was Benjamin Franklin. Of course, the USA Constitution in it's purest sense would REQUIRE the people to embrace it, love it and protect it. The USA Constitution was never supposed to oppress and victimize Americans. Never. It was written to uphold the right of humans to live without oppression.

To completely understand the magnificence of the USA Constitution it to understand the love the founders had for self-expression. The USA Constitution takes a back seat to the citizen and their right to their own expression of their personal lives that achieve happiness. The USA Constitution codified The Declaration of Independence.

Alito is nothing but corruption and egregiously so. He is attempting to provide a big thank you to the Federalist Society for his seat and the seats of those that disregard THE CITIZEN and put religious dogma in their place along with money as a vote. There is profound incompetence in the Robert's Court and it must be addressed.

Somehow over a length of time 85 essays by Thomas Jefferson, John Jay and James Madison has displaced the USA Constitution as if it is a religion all by itself. It is time to get over it and uphold the USA Constitution and the Declaration of Independence at the heart of this democracy. John Jay was the first Chief Justice. He was also an abolitionist. But, he was never a signator to the USA Constitution. It is gross malpractice to put the Federalist Papers ahead of the essence of the USA Constitution.

I cannot conceive President and Commander and Chief George Washington rejecting any American as a citizen without clear equality under the law. Alito is in violation of the USA Constitution and he needs to go. It is time to end the political violation that is accepted as status quo coming from the Federalist Society. The USA Constitution needs a champion and I can't think of anyone more qualified and with clout as Former President Barak Obama and our lovely First Lady. They need to bring about a non-profit that will carry this revitalization of the USA Constitution forward. If the right political wing wants an originalist practice of the law, it is time we actually provide it!

In the draft, Alito sought to distinguish abortion from other rights because it, unlike the others, destroys what the Roe ruling called "potential life."

"Nothing in this opinion should be understood to cast doubt on precedents that do not concern abortion," Alito wrote.

Sepper said that Alito is "not particularly convincing because he doesn't do the work to distinguish those cases in a meaningful way." She added: "It's a really sweeping opinion. It doesn't pull any punches when it comes to the abortion right."

Alito's opinion resembles his dissent in the court's same-sex marriage ruling in which he said the 14th Amendment's due process promise protects only rights deeply rooted in America's history and tradition.

"And it is beyond dispute that the right to same-sex marriage is not among those rights," Alito wrote in his 2015 dissent.

Some conservative commentators have suggested that Alito has provided a road map for future attempts to eliminate other guaranteed liberties. Other legal scholars doubt that there is either a willingness on the court or in legislatures to eliminate other rights....

The Pandemic

It’s hanging around for a while isn’t it? And the longer it is with us the more easy it is to see the consequences of allowing a coronavirus to be rampant among human beings. I’ll get links later but we’re now facing long Covid, variants that continue to plague and real consequences that are irreversible. There is a study out recently that even the mild cases of this virus have caused brain shrinking. It is time to human race get serious about getting rid of this lousy set of viruses in our societies. It is the one true problem we all share and on balance others and genocide it is worse than Russia.

The sciences and medical research knew exactly what they were looking at from the beginning and no one listened. The one country that came close to doing exactly what needed to be done from the beginning has been New Zealand.

I might add the virus acted exactly as expected. The scientist dealing with this virus know exactly what they are looking at.

Quality of Life

Everyone in the world should have this mimimal standard. Health, including a good, reliable food and water source, a place to call home, and a secure way to maintain quality of life.

Every American should be able to achieve a basic quality of life. Once a home and health is secured there is so much more possible, like education and opportunity to advance more comforts of living a good and healthy life. Hobbies and enjoyment are all part of the quality of life.

Lifestyles are personal choices. Those personal choices are called happiness. Find yourself in quality of life and everything else comes into focus. Do the basics and be secure in the future.

Legendary pilot (click here) has shot down 40 Russian planes

Ukraine has suffered a setback (click here) against the Russian aggression as one of its brave pilot dubbed as 'Ghost of Kyiv' was killed last month according to the report published in Times of London.The identity of the pilot was revealed as Stepan Tarabalka.

Ukrainian officials confirmed the death of the 'Ghost of Kyiv', saying that pilot Major Stepan Tarabalka was killed during the war last month. The Ukrainian officials said that the brave pilot has shot down 40 Russian jets before he was killed by the Russian forces.''

According to the publication, the pilot was flying a MiG-29 which was shot down on 13 of last month while fighting an “overwhelming" number of enemy forces....

He (click here) was fearless and feared in the skies above Ukraine.

The southern port city of Mariupol (click here) has been the site of some of the fiercest fighting seen thus far in the Russia-Ukraine conflict. On March 16, Mariupol's deputy mayor, Serhiy Orlov, estimated that between 80%-90% of the city's buildings had been damaged. In the six weeks of continued fighting that followed, the situation has only gotten worse.

Russian domestic television, however, presented its audience with an alternative version of events. A four-minute news segment broadcast on Russia's First Channel on the evening of April 28 made the following claim:

"After explosions, firefights, pain, and blood, Mariupol is returning to normal life, and as a notable symbol of this, schools are already accumulating lists of students....

I have said this from the beginning. Now the Russian Victory Day is coming up and this is a very dangerous time for the world. I would expect anything to happen.

Victory Day in Russia is about nationalism. The world needs to be on guard when the day of nationalism comes and goes. He is using the idea of nazis to win elections. Victory Day and the illusion of having changed the path of Russian Speaking people to the "righteous path," might be enough for Putin. He might simply move on, but, there is a chance he will insist the hatred of the Russia people as grown to the point of intolerable after being the savior of Mariupol. 

It is a very dangerous time for the world. There is no doubt in my mind the communists and other violent regimes are taking aim at The West and allies of freedom and democracy. The question is will they decide engaging power to bring a war to conclude the final solution is actually the best path forward or will they come to terms that The West and allies of freedom and democracy to TRY AND CREATE an opportunity for economic growth and prosperity?

I think the idea the communists and violent regimes will look for economic opportunity is remote. It probably exists among the political parties within the countries, but, those parties are in the minority. Recently Aung San Suu Kyi was convicted of corruption. Alexei Navalny is in prison and just had his sentence increased. One of the reasons he went back to Russia was to let the people witness the complete control and power Putin holds over innocent people. The man was poisoned by Russian agents and no one even bothers to investigate or hold the guilty responsible. If Russia doesn't want to extradict then convict attempted murders for what they are.

The Free World can all witness now the depth of deception regarding Mariupol. The city has been leveled to rubble and the remaining citizens forced to starve to death. And the Russian media is painting pretty pictures for the people who are helpless to end their own corruption.

This is a very dangerous time in the world. Very.

White Supremacy doesn't see any difference in living in or out of a jail or prison. It is a continuous timeline. The prison system has to handle them so they cannot victimize innocent people and family not in prison while the inmates have all the time in the world to plot against the government, banks, and businessmen. Brian Ulrich, 44, of Georgia pleaded guilty on Friday during a hearing in federal court in Washington DC. He sobbed as the judge warned he could face up to 20 years in prison, though sentencing guidelines call for much less time....

This is a well established underworld in the USA. These are the people Donald John Trump called friends, associates and constituents. It is time to handle this as more than a PERSONAL PREFFERENCE in lifestyles and call it what it is, an underworld that is bonded with racism and freely kills whomever they deem a problem to their population. There are charges that have to be investigated including racketeering. The paradigm has to change. These are people that disregard authority and attempt to make their own world with hatred and violence. Enough of this. These people are open about their identity and their methods. This is more than any civilized society should tolerate. They chronically subvert the values of this country and actively recruit young teens to serve their purpose and propagate the hate.

The prison system has enough on their hands with gang behavior within the system, then add those that don't respect the prison bars and realize they have to reform and use their miserable lives to undermine the decency of American values to create their own power structure to propagate the same hatred they exhibited outside of prison. The judges and the prison system need to invoke measures to separate these people from their enablers outside the prison. They need to accept they are wrong.

Trump’s impossible to climb border wall is killing too many people.

In the Washington Post there is an accounting of a border that is difficult to scale but killing those that try. That is a human rights violation. 

If all we needed was a wall we would not need border patrols. The Border Patrol is in place to apprehend illegal crossers. A wall that kills is anti-American. 

There better alternatives. Southern California has a triple redundant wall and it works to discourage crossing. No wall will be foolproof but there are methods to discourage people from coming to the USA as the only desperate way to save their own lives.

The people trying to scale the wall are making across the Rio Grande but then dying on American soil. Some will applaud at the great feat, but, it is wrong. The Border Patrol are incredible people and love this country, but, are compassionate as well. Cruelty to children is out of the question. 

There are answers to prevent and end border crossing, this wall is a disgrace to the values this country represents to the world. 

The USA and President Biden are heroes to the people of Ukraine.

I just wish Americans would appreciate President Biden more and realize how he is making the USA a hero to so many other countries. This is literally a moment in history when democracy becomes secure in a world of hate of freedom.

This pivot by Putin comes after the reliquishment by Trump of so many classified documents that communists feel emboldened to run over top of any country in the world that embraces democracy.

THIS IS IT. Everyone needs to understand this is a make or break moment for Russia. If it cannot deliver Ukraine it's global impact will diminish. There are upsides to that and there are downsides, ie: Iran is breaking out of diplomatic solutions to develop it's OWN nukes. The assassination of generals under Trump unleashed the power within Iran to do as it sees fit.

Russia ended petroleum energy solutions to two countries. That is aggression. It weakens the countries infrastructure and prepares them for invasion. Just that simple. It is up to the USA and it's many resources and the USA military to now provide new alternatives to Putin's petroleum. This is a great moment for the USA and it's allies. It sincerely is. 

This is more about freedom and democracy than anyone in The West wants to admit. This is JUST Russia being stupid about it's economy and that potential of a global network of economic strengths. THAT IS NOT IT. This is about ideology and the implementation of means to end democracy and force imperialism on everyone on Earth. 

North Korea, Iran, Syria, China, Russia, etc. are all prepared to unleash "the final solution" on The West and it's many allies. 

Imagine a world where democracy empowers the people and results in sustainable economies for every person on the globe. Just imagine that. Where is the power then that the communists understand and adhere to regardless of it's folly? 

The West has appeased too long to provide for a stable international balance. Putin wants to end international balance and instill dictatorships around the world. Say good-bye to Twitter all together if that happens and enforced and rigid rules will result in oppression and poverty. We are at a boiling point and we also have the best diplomats in the world leading an effort toward peace. The ideology may be cracking and peace may very well result, but, the strength of the USA must be understood and it's agenda of peace and prosperity accepted. 

Communism is like religion to those that practice it. There is no turning back for them. 

President Biden is perfectly placed at this time when so much of our governance and future for our generations to come are at stake. The American people need to appreciate this moment in time and realize how safe they are in his hands. He lived his life for this. Communism can exist, but, it has to exist peacefully and the entire world needs to understand that nukes are not the way into the future, they are nothing more than assured mutual destruction. That is not a national defense, that is a weapon of fear and there is nothing to fear.
