The NICS was created within the Brady Handgun Violence Prevention Act (Brady Act) of 1993.
I want to point to a reality that many don't refer to in regard to gun control. Senator Cornyn's lethargy in regard to solving the problem of gun violence is HISTORIC. It is the 'default' setting of Republicans. It is where Republicans that don't think for a living lives. If the rhetoric works then use it. That is insulting, but, it is true; The Brady Bill is the example proving evidence.
The campaign for a gun control started before Sarah Brady but was not well recognized until she became involved with a healing spouse at home. There was an organization established in 1974 named Handgun Control, Inc. (HCL). It provided a platform the Brady Campaign. So, we have been on this track for decades. It will take great effort to turn the corner on what every American knows is best for the country and legally possible. The NRA has polluted our country with lethality / deadliness within it's borders that should not exist. That reality is provable. Very provable. As the number and lethality / deadliness of weapons in the USA increased so have the causalities. They simply are not necessary in the USA. But, back to the Brady Campaign.
Previous to the Presidential Campaign of 1992 there were efforts to pass control legislation, but, Reagan and the Republicans would have nothing to do with it. Sarah and James Brady were in a precarious set of circumstances. They were Republicans. James had a close relationship with Reagan. Yet, there was nothing the Reagan Administration was going to do about gun control. The argument was 'Reagan could have been assassinated and he doesn't think it is necessary.'
At the Democratic National Convention, James Brady now in a wheelchair with his spouse, Sarah, at his side made an appearance to promises for legislation to go forward. The then Presidential nominee, Bill Clinton, took up the mantle of gun control. It was after his election the Brady Bill was finally written and passed into law.
So, to know the LETHARGY of the Republicans is to understand why they are seeking to stand in the background with baseless criticism of President Obama and the Democrats.
We know for a fact new legislation for gun control to penalize straw purchasers, criminalize interstate transportation / trafficking of guns and a better criminal background program and compliance will bring about a shift in the violence and the deaths. That is a fact. So, the rhetoric noted by the Republicans is their default setting void of facts and good governance.

Mandated by the Brady Handgun Violence Prevention Act (Brady Act) of 1993, Public Law 103-159, the National Instant Criminal Background Check System (NICS) was established for Federal Firearms Licensees (FFLs) to contact by telephone, or other electronic means, for information to be supplied immediately on whether the transfer of a firearm would be in violation of Section 922 (g) or (n) of Title 18, United States Code, or state law. The Brady Act is a public record and is available from many sources including the Internet at www.atf.gov.
The Brady Bill resulted from the attempted assassination of then President Ronald Reagan. James Scott "Jim" Brady was Assistant to the President. He was in the line of fire when the attempted assassination was carried out. He immediately suffered from an injury that would disable him for life. His spouse has been pivotal in his recovery and moving The Brady Bill forward, but, the way it moved forward was remarkable.
It was originally reported James Brady was dead. That report was made across the media, except for CNN. Later that evening the media services had to retract their reporting and fall in line with CNN that Brady was wounded, but, alive.
