Minimum Wage
- Florida has a state minimum wage law. (Fla. Const. Art. X, § 24, Fla. Stat. § 448.110)
- The current state minimum wage is $8.65/hour.
- On September 30, 2021, the minimum wage will increase to $10.00/hour. It will then increase each year by an additional $1/hour until it reaches $15.00/hour on September 30, 2026.
- On September 30, 2027 and on each subsequent September 30th, the minimum wage will increase by the rate of inflation and the consumer price index or by a successor index calculated by DOL.
- There are multiple wage rates for different occupations such as tipped workers.
- The minimum wage provision is implemented through the Florida Minimum Wage Act, which has several procedural requirements that must be met before filing suit. (Fla. Stat. § 448.110(6))
- Agricultural worker coverage is co-extensive with FLSA. Agricultural workers exempt from FLSA are also exempt from the Florida minimum wage law.
