It appears the Chief Justice himself holds a prejudice that the country is better off without any racial delineation to any law. That is an admirable goal, but, his responsibility is not to drive change through being an activist on the bench, but, enforce the Constitution.
The Voting Rights Act of 1964 was passed to end the influence of racism in elections. It seems the Chief Justice is out of touch in his clear understanding of the current administration. Trump is not only a racist, he is a Christian Nationalist (click here) with his own bible.
So, while attempting to remove the stigma of racism in the country is a noble cause, and while Lady Justice is blind, evidently Trump is not, actually or figuratively.
Racial profiling is also being used on Americans, not just the undocumented. With a rare occasion, the Undocumented being detained and/or exported to foreign prisons are not drug gang members. I realize the six conservative judges thinks everything is politics, but, shouldn’t the politics reflect a string understanding of reality?
The Chief Justice’s ideology should not rule the day, the USA Constitution and its Amendments should. There is not one Amendment up for repeal either. The Rule of Law should rule the day with a heaping serving of reality. Theory and ideology belongs to academia, not the courts.
